1) Relationship to Cuby Holdings

Vesselborn (vesselborn.com) is an imprint and property of Cuby Holdings LLC. These Terms incorporate by reference the Cuby Holdings Terms of Service. If there is any conflict, the Cuby Holdings Terms control.

2) Scope

These Terms apply to your use of the Vesselborn site and any purchases made through it (the “Services”). By using the Services, you agree to these Terms.

3) Purchases & Payments

Payments are processed by third-party providers (e.g., Stripe). By purchasing, you authorize charges for the displayed amounts, including any applicable taxes and shipping.

4) Taxes

Prices are exclusive of taxes. Where required, sales or use tax is calculated at checkout based on your location and collected on behalf of Cuby Holdings LLC. You are responsible for any taxes not collected at checkout.

5) Digital Products

Unless expressly stated otherwise on a product page, digital items (e.g., e-books, PDFs, downloads) are sold as a personal, non-transferable license for your own use. Redistribution, resale, public uploading, or creation of derivative works without written permission is prohibited.

6) Delivery

• Digital items: delivered via download link or email after successful payment.
• Physical goods: shipped to the address you provide; title and risk of loss transfer upon carrier acceptance. Delivery windows are estimates, not guarantees.

7) Refunds & Cancellations

• Digital items: all sales are final once delivery occurs. For technical issues (corrupted file, duplicate charge), contact [email protected]. within 7 days; we will repair, replace, or refund at our discretion.
• Physical goods: unopened/unused items may be returned within 30 days with proof of purchase; customer pays return shipping unless the item arrived damaged or incorrect.
• Chargebacks: contact us first to resolve issues. Unauthorized or fraudulent chargebacks may result in account restriction.

8) Intellectual Property

All Vesselborn content, trademarks, and related materials are owned by Cuby Holdings LLC or its licensors and protected by law. No reproduction, distribution, modification, public display, or commercial use is permitted without prior written permission.

9) Acceptable Use

You may not use the Services to violate law, infringe rights, interfere with security or operation, or attempt unauthorized access to any system, data, or account.

10) Disclaimers; Limitation of Liability

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, Cuby Holdings LLC disclaims all warranties and will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability will not exceed the amount you paid for the transaction at issue.

11) Governing Law; Venue

These Terms are governed by the laws of the Commonwealth of Virginia. Courts located in Arlington County, Virginia shall have exclusive jurisdiction.
